PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY AND MAKE SURE THAT YOU UNDERSTAND THEM BEFORE CONFIRMING YOUR ACCEPTANCE. BY PLACING AN ORDER EITHER IN PERSON OR THROUGH OUR WEBSITE, YOU ARE AGREEING TO BE BOUND BY THESE TERMS AND THEY FORM THE BASIS OF THE CONTRACT.
These terms and conditions do not in any way affect your statutory rights as a customer. Further information can be provided on request.
1. Definitions
1.1 “We” are:
Vanilla and Dreams Cake Design trading as Vanilla and Dreams of Unit 3B Middleton South, Wagonway Drive, Newcastele Upon Tyne, NE13 9BJ
(“We”/”The Seller”)
“You" are:
The person or person’s who have requested and received the Invoice and Terms and Conditions, as well as the person who purchases and receives the goods. Where there is more than one person, they shall be jointly and severally liable.
(“You"/”The Customer")
1.2 The “Goods” is defined as the items to be supplied by “The Seller" to “The Customer” as listed in the Invoice.
1.3 We, the Seller, can be contacted via our website at vanillaanddreams.co.uk, by email at hello@vanillaanddreams.co.uk, or by telephone on 0191 236 3958. As detailed in these terms, some contact is requested by email only.
2. General
2.1 These “Terms and Conditions” shall apply to the sale of the “Goods” by “The Seller” to “The Customer”, to the exclusion of all other terms and conditions referred, except where “The Seller” has agreed to such variation in writing and by way of signature. Both “The Seller” and “The Customer” agree to be legally bound by these “Terms and Conditions”. It is the responsibility of “The Customer” to check all details in the Invoice are correct and accurate when completing their order.
3. Deposit and Payments
3.1 All price quotations are valid for 4 weeks from the date of issue.
3.2 We require a minimum order value of £400 per booking, exclusive of delivery and equipment hire charges.
3.3 We require a £50 deposit to secure a booking and delivery date. This deposit is non-refundable and non-transferable.
3.4 We require the remaining balance of the full order value no later than 6 weeks prior to the initial agreed date of delivery. In the event you have to cancel within 6 weeks of the delivery date, you are liable to pay the seller 50% of the total order value at the time of cancellation. All cancellations must be made by email.
4. Consultation Appointments and Cake Sampling
4.1 Appointments can be arranged if desired, once the initial deposit has been received and acknowledged. Such appointments are limited to the attendance of two person’s per booking.
4.2 Postal cake samples can be arranged and costs are calculated upon receipt of such requests.
5. Design
5.1 Design changes will not be accepted unless they are submitted and acknowledged prior to the 6 week deadline of the agreed delivery date. All design changes must be submitted by email.
5.2 All requested and acknowledged design or recipe changes are subject to additional charges and recalculation of the total order value.
5.3 We reserve the right to make changes to the design and/or recipe of the goods, if circumstances beyond our control compromise the quality of the goods. Should such changes be required, practicable notice will be given.
6. Delivery and Equipment Hire
6.1 Collection of wedding cakes by the customer is not permitted. We must deliver all such goods to ensure the order arrives undamaged and because transit of goods are subject to strict Food Safety guidelines.
6.2 Delivery of the goods are subject to a 45p per mile charge. This is calculated as a round trip charge from the registered address of the seller, to the agreed delivery venue.
6.3 Stand and Display Box hire is available for a charge of £10 and upwards, dependant on the items requested. All equipment hire is also subject to a £25 deposit, which will be returned if such equipment is returned safely and undamaged within 5 days after the agreed delivery date.
7. Allergies and Intolerances
7.1 We can provide a list of all allergens upon request.
7.2 We can not give any guarantees that our goods do not include allergens or any ingredients that persons may be intolerant of. Some decorations such as fresh flowers and ribbons are not edible and it is the responsibility of the customer to inform all person’s of this. We are not responsible for any harm caused from anyone ingesting such allergens, decorations or ingredients or from harm caused by touching our goods.
7.3 It is the responsibility of the customer to inform anyone with allergies or intolerances of the points raised and agreed to in part 7.2
8. Complaints
8.1 In the event you are unhappy with your order, any complaints or concerns should be raised as soon as is practicable and in any event within 14 days of the delivery date. Please do so by email and include any evidence to support your complaint. Any refunds or partial refunds are entirely at the discretion of the seller.
9. Declarations
I, “The Customer”, have read and understood the Terms and Conditions and I agree to be legally bound to adhere to them. I acknowledge this by means of my signature below.
